Agreement to Terms

By downloading, installing, or using Tintback ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.

Description of Service

Tintback is an AI-powered photo colorization service that transforms black and white photographs into color. The service is provided on a credit-based system where users receive free credits upon signup and may purchase additional credits.

Credits and Pricing

The App operates on a credit system:

• New users receive free credits upon initial signup
• Standard colorization costs 1 credit per photo
• Premium colorization costs 3 credits per photo
• Credits do not expire
• Credits are non-transferable between accounts

Purchases and Refunds

All purchases are processed through Apple's App Store. Refund requests are handled by Apple according to their refund policy. We do not have the ability to process refunds directly. To request a refund, please contact Apple Support or use the "Report a Problem" feature in your purchase history.

Acceptable Use

You agree not to upload photos that contain:

• Explicit, pornographic, or sexually suggestive content
• Violent, harmful, or disturbing imagery
• Content that infringes on copyrights or intellectual property rights
• Illegal content or content that promotes illegal activities
• Hateful, discriminatory, or harassing content
• Content depicting child exploitation or abuse

We reserve the right to remove any content that violates these guidelines and to terminate accounts that repeatedly violate our acceptable use policy.

Intellectual Property

You retain ownership of the original photos you upload. By using the App, you grant Tintback a license to process, store, and display your photos as necessary to provide the service.

For photos colorized using free credits: you grant Tintback a non-exclusive, royalty-free license to use the before and after images for marketing, promotional, and training purposes.

AI Processing and Results

Our colorization is performed by artificial intelligence. Results may vary and we do not guarantee historical accuracy of colors. The AI makes educated predictions based on image content and training data.

Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

Account Termination

You may delete your account at any time through the App settings. We may terminate or suspend accounts that violate these terms. Upon termination, your photos and data will be permanently deleted.

Limitation of Liability

To the maximum extent permitted by law, Tintback shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the App.

The App is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Indemnification

You agree to indemnify and hold harmless Tintback and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these terms.

Changes to Terms

We may modify these terms at any time. Continued use of the App after changes constitutes acceptance of the new terms. We will notify users of significant changes through the App or by updating the "Last updated" date.

Governing Law

These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
